Rights of use and habitation are established and lost in the same way as usufruct.
It cannot be enjoyed, as in the case of usufruct, without first giving security and making statements and inventories.
The user, and he who has a right of habitation, must enjoy reasonable.
The rights of use and habitation are regulated by the title which established them and receive, according to its provisions, more or less extent.
If the title does not explain the extent of these rights they are settled as follows.
A person who has the use of the fruits of land may only demand as much as he needs for his needs and those of his family. He may demand it for the needs even of children who have arisen to him since the grant of the use.
The user may not assign or lease his right to another.
He who has a right of habitation in a house may live there with his family, even if he had not been married at the time the right was given to him.
The right of habitation is restricted to what is necessary for the habitation of the person to whom this right is granted and his family.
The right of dwelling may not be assigned or leased.
