The creation of an aerodrome intended for public air traffic, when it does not belong to the State, is subject to the conclusion of an agreement between the Minister responsible for civil aviation and the natural person or the public or private legal entity creating the aerodrome.
Where the signatory fails to fulfil its obligations under the agreement provided for in article L. 221-1, the Minister in charge of civil aviation shall, if necessary, either order the operation of the aerodrome to be managed by a public authority at the expense of the signatory of the agreement, or terminate the agreement.
