Chapter III: Conditions for setting up certain healthcare activities and heavy equipment

Authorisation to operate a mobile emergency and resuscitation unit can only be granted to a healthcare establishment if it has authorisation to operate an emergency unit or if it simultaneously obtains this authorisation.

Authorisation to operate a paediatric mobile emergency and resuscitation unit can only be granted to a healthcare establishment if it has authorisation to operate a paediatric emergency unit or if it simultaneously obtains this authorisation.

In order to deal with a particular situation, a health care organisation authorised to carry out the activity mentioned in 3° of article R. 6123-1 may be authorised to operate a seasonal mobile emergency and resuscitation structure.

Exceptionally, when the local situation justifies it, a health establishment authorised to carry out the activity mentioned in 2° of article R. 6123-1 may be authorised, after consultation with the departmental committee for emergency medical aid, permanent care and medical transport, to set up resources outside the establishment, intended to operate, on a temporary or permanent basis, a branch of the mobile emergency and resuscitation structure.

Authorisation to carry out the activity mentioned in 3° of Article R. 6123-1 may only be granted to a health care establishment if it satisfies the following conditions: 1° It has full inpatient medical beds ; 2° It has access to a technical platform for surgery, medical imaging and medical biology analyses, either within the establishment itself or under an agreement with another healthcare establishment, an imaging practice or a…

A health care establishment may be authorised to provide exclusive care for sick or injured children in a paediatric emergency unit mentioned in 3° of article R. 6123-1.

A health care establishment may, in view of a particular situation, be authorised to operate an emergency facility for part of the year only, provided that the arrangements for patient care by another establishment authorised to carry out the activity mentioned in 3° of article R. 6123-1 are organised within the framework of the network provided for in article R. 6123-26.

A health establishment whose emergency medicine activity is below a threshold set by order of the Minister for Health may be authorised to carry out the activity mentioned in 3° of article R. 6123-1, provided that it participates in an inter-hospital medical federation or a health cooperation grouping in order to set up a joint team with establishments authorised for the same activity and having a higher level of activity.

Without prejudice to the provisions of article R. 6123-32-9, the provisions of this section do not apply to the health establishments mentioned in the first paragraph of article L. 3211-1 and article L. 3222-1, which receive patients with mental disorders on a permanent basis.
