Branch agreements and professional or inter-professional agreements are filed with the central services of the Minister of Labour. When the texts concern agricultural professions, they are filed with the regional directorate for companies, competition, consumption, labour and employment.
Group, company, establishment and inter-company agreements, as well as the documents accompanying the filing as provided for in articles D. 2231-6 and D. 2231-7, are filed on the Ministry of Labour’s electronic filing platform.
The departmental service responsible for depositing collective labour agreements is the one in whose jurisdiction they were concluded.
Where a company collective agreement applies to establishments with different locations, the text submitted is accompanied by a list of these establishments and their respective addresses.
The filing of agreements and arrangements must be accompanied by the following documents: 1° In all cases, a) The signed version of the parties; b) A copy of the letter, electronic mail or dated receipt or acknowledgement of receipt notifying all representative organisations of the text following the signature procedure; 2° For branch, group, company, establishment and inter-company agreements, a) A publishable version as referred to in article L. 2231-5-1,…
Declarations of accession or denunciation, made in application of articles L. 2261-3 and L. 2261-9, are deposited, in accordance with the procedures laid down in article D. 2231-4 and in 1 o of article D. 2231-7, by the party that has signed them with the department that holds the agreement or convention that they concern. A receipt is issued to the depositor.
Any interested party may consult, free of charge, the texts filed with the regional directorate for companies, competition, consumption, labour and employment. They may obtain a copy, at their own expense, in accordance with the procedures set out in article L. 311-9 of the Code des relations entre le public et l’administration.
