French Guiana is a territorial collectivity of the Republic governed by Article 73 of the Constitution, which exercises the powers attributed to an overseas department and an overseas region and all the powers devolved to it by law to take account of its particular characteristics and constraints.
The territorial collectivity of French Guyana succeeds the department of French Guyana and the region of French Guyana in all their rights and obligations.
The determination and transfer of the capital of the territorial collectivity of French Guyana is decided by decree in the Conseil d’Etat, after consultation with the Assembly of French Guyana and the municipal councils of the communes concerned.

The bodies of the territorial collectivity of French Guiana comprise the assembly of French Guiana and its president, assisted by the economic, social, environmental, cultural and educational council of French Guiana and the great customary council of the Amerindian and Bushinenge populations.
No person may at the same time be a councillor of the Assembly of French Guyana and a member of the Economic, Social, Environmental, Cultural and Education Council of French Guyana.
The composition of the Assembly of French Guyana and the term of office of the councillors to the Assembly of French Guyana are determined by Chapter I of Title I of Book VI bis of the Electoral Code.
When a councillor to the Assembly of French Guyana tenders his resignation, he shall send it to the President of the Assembly of French Guyana who shall immediately notify the representative of the State in the territorial collectivity.
Any councillor to the Assembly of French Guyana who, without a valid excuse, has refused to carry out one of the functions devolved upon him by the laws shall be declared to have resigned by the Council of State. When the functioning of the Assembly of French Guyana proves impossible, the Government may pronounce its dissolution by reasoned decree taken in the Council of Ministers; it shall inform Parliament of this as soon as possible. Dissolution may never be pronounced by way of a general measure.
