Article 113 of the French Code of Criminal Procedure

If the witness heard under the conditions provided for in the previous article was not unable to appear on the summons, the examining magistrate may impose the fine provided for in Article 109.

Si le témoin entendu dans les conditions prévues à l’article précédent n’était pas dans l’impossibilité de comparaître sur la citation, le juge d’instruction peut prononcer contre ce témoin l’amende prévue à l’article 109.
