Article 2437 of the French Civil Code

Cancellation not consented to shall be applied for in the court within whose jurisdiction the entry was made, except where that entry was made as security for a possible or indeterminate sentence, on the enforcement or liquidation of which the debtor and the alleged creditor are pending or are to be tried in another court; in which case the application for cancellation must be brought there or referred there.

However, the agreement made by the creditor and the debtor, to bring, in the event of a dispute, the application to a court designated by them, will receive its execution between them.

La radiation non consentie est demandée au tribunal dans le ressort duquel l’inscription a été faite, si ce n’est lorsque cette inscription a eu lieu pour sûreté d’une condamnation éventuelle ou indéterminée, sur l’exécution ou liquidation de laquelle le débiteur et le créancier prétendu sont en instance ou doivent être jugés dans un autre tribunal ; auquel cas la demande en radiation doit y être portée ou renvoyée.

Cependant la convention faite par le créancier et le débiteur, de porter, en cas de contestation, la demande à un tribunal qu’ils auraient désigné, recevra son exécution entre eux.
