Article 349 nonies of the French Customs Code

Any dispute relating to the recovery of sums in application of this code must be addressed to the accounting officer responsible for recovery within two months of notification of the debt recovery action or the decision to allocate or transfer an asset.

The accounting officer will make a decision within two months of receipt of the objection.

On receipt of the accounting officer’s decision or on expiry of the period allowed for the accounting officer to make his decision, the person lodging the objection has two months in which to summon the accounting officer before the enforcement judge.

Article 349 nonies

Toute contestation relative au recouvrement des sommes effectué en application du présent code est adressée, dans un délai de deux mois à compter de la notification de l’acte de poursuite ou de la décision d’affectation ou de cession d’un bien, au comptable chargé du recouvrement.

Le comptable se prononce dans un délai de deux mois à compter de la réception de la contestation.

A réception de la décision du comptable ou à l’expiration du délai imparti au comptable pour prendre sa décision, l’auteur de la contestation dispose d’un délai de deux mois pour assigner le comptable devant le juge de l’exécution.
