Article 409 of the French Civil Code

Guardianship includes a subrogated guardian appointed by the family council from among its members.

If the guardian is a relative or ally of the minor in one branch, the subrogated guardian is chosen, as far as possible, from the other branch.

The office of the subrogated guardian ceases on the same date as that of the guardian.

La tutelle comporte un subrogé tuteur nommé par le conseil de famille parmi ses membres.

Si le tuteur est parent ou allié du mineur dans une branche, le subrogé tuteur est choisi, dans la mesure du possible, dans l’autre branche.

La charge du subrogé tuteur cesse à la même date que celle du tuteur.
