If the execution of the European Investigation Order is likely to harm essential national security interests, endanger the source of information or involve the use of information that has been classified pursuant to the provisions of article 413-9 of the Penal Code and relating to intelligence activities, the provisions of articles 694-4 and 694-4-1 of this Code shall apply, and recognition or enforcement of the European Investigation Order may be refused by the Minister of Justice.
Before taking his decision, the Minister for Justice shall consult the issuing authority by any appropriate means and, where appropriate, shall ask it to provide any necessary information without delay.
If the Minister of Justice decides not to refuse recognition or execution of the European Investigation Order and the information in question is classified pursuant to the provisions of Article 413-9 of the Criminal Code, the provisions of 3° of Article 694-31 of this Code shall apply.
