In the case provided for in Article LO 6221-3, the compulsory resignation of the members of the Territorial Council of Saint-Barthélemy is pronounced by the Administrative Court.
The President of the Territorial Council, after refusal established under the conditions set out in Article LO 6221-3, shall refer the matter to the Administrative Court within a period of one month, on pain of forfeiture.
Failing to rule within the period set out in the previous paragraph, the Administrative Court shall be dismissed. The chief clerk shall inform the president of the territorial council of this, informing him that he has a period of one month, on pain of forfeiture, to refer the matter to the Conseil d’Etat.
When the administrative tribunal declares the resignation of a territorial councillor, the chief clerk informs the interested party that he has a period of one month to appeal to the Conseil d’Etat.
The challenge is investigated and judged without costs by the Conseil d’Etat within a period of three months.
