The Regional Council decides on the acquisition of a stake in the capital of a commercial company on the basis of a report drawn up by one or more experts chosen from persons offering every guarantee of independence, good repute, competence in the valuation of companies and company shares and knowledge of the business sector concerned and the local market.
This report includes in particular:
1° An analysis of the financial situation of the company and its prospects for development;
2° An assessment of the real value of the company according to objective methods commonly practised for the total or partial disposal of company assets;
3° An assessment of the prudent nature of the investment;
4° A technical analysis of the legal qualification of the proposed capital holding in the light of the conditions laid down in paragraph 1 of Article 107 of the Treaty on the Functioning of the European Union.
This report is appended to the deliberation of the Regional Council.
