Article 275 of the French Civil Code

Where the debtor is unable to pay the capital sum under the conditions set out in article 274, the judge shall determine the terms of payment of the capital, up to a limit of eight years, in the form of periodic payments indexed in accordance with the rules applicable to maintenance payments.

The debtor may request a review of these payment arrangements in the event of a material change in his or her circumstances. Exceptionally, the judge may then, by special reasoned decision, authorise the capital to be paid over a total period of more than eight years.

The debtor may release the balance of the index-linked capital at any time.

After the matrimonial property regime has been liquidated, the creditor of the compensatory allowance may apply to the judge for payment of the balance of the index-linked capital.

Article 275

Lorsque le débiteur n’est pas en mesure de verser le capital dans les conditions prévues par l’article 274, le juge fixe les modalités de paiement du capital, dans la limite de huit années, sous forme de versements périodiques indexés selon les règles applicables aux pensions alimentaires.

Le débiteur peut demander la révision de ces modalités de paiement en cas de changement important de sa situation. A titre exceptionnel, le juge peut alors, par décision spéciale et motivée, autoriser le versement du capital sur une durée totale supérieure à huit ans.

Le débiteur peut se libérer à tout moment du solde du capital indexé.

Après la liquidation du régime matrimonial, le créancier de la prestation compensatoire peut saisir le juge d’une demande en paiement du solde du capital indexé.
