Article 529-5-1 of the French Code of Criminal Procedure

Officers of the public prosecutor’s office at one or more police courts, the list and jurisdiction of which shall be determined by decree, shall be competent to issue enforcement orders for the increased fixed fines provided for by article 529-5 when they concern offences mentioned in article 529-3 and committed to the detriment of certain operators of public passenger transport services, the list of which is specified by decree. In the event of a protest or claim that should give rise to a referral to the Police Court, these officers of the Public Prosecutor’s Office will forward the case file to the Public Prosecutor’s Office with jurisdiction over the offender’s place of residence.

Les officiers du ministère public près d’un ou plusieurs tribunaux de police dont la liste et le ressort sont fixés par décret sont compétents pour établir les titres exécutoires des amendes forfaitaires majorées prévus par l’article 529-5 lorsqu’ils concernent des contraventions mentionnées à l’article 529-3 et commises au préjudice de certains exploitants de services de transport public de personnes dont la liste est précisée par décret. En cas de protestation ou de réclamation devant donner lieu à la saisine du tribunal de police, ces officiers du ministère public transmettent le dossier de la procédure au ministère public compétent à raison du domicile du contrevenant.
