The public prosecutor at a judicial court other than those referred to in Article 706-107 may, for offences falling within the scope of this article, request the investigating judge to relinquish jurisdiction in favour of the investigating court with jurisdiction pursuant to this article. The parties shall be notified in advance and invited to make their observations by the investigating judge; the order shall be made eight days at the earliest and one month at the latest from such notification.
When the examining magistrate decides to relinquish jurisdiction, his order does not take effect until the five-day period provided for in Article 706-111 has elapsed; when an appeal is lodged pursuant to this Article, the examining magistrate remains seised until he is notified of the judgment of the Investigating Chamber, which has become res judicata, or that of the Criminal Division of the Court of Cassation.
As soon as the order has become res judicata, the public prosecutor sends the case file to the public prosecutor at the court with jurisdiction pursuant to Article 706-109.
The provisions of this article shall apply before the Investigating Chamber.
