When the Autorité de contrôle prudentiel et de résolution is informed by the supervisory authority of a host Member State where an insurance or reinsurance undertaking with its head office in France operates under the freedom to provide services or the freedom of establishment, that this undertaking does not comply with the legal provisions of that Member State and has not complied with the injunction to do so addressed to it by that authority, the Autorité de contrôle prudentiel et de résolution shall, as soon as possible, take all appropriate measures with regard to the undertaking in order to put an end to this irregular situation. It shall inform the supervisory authority of the other Member State of these measures.
In the event of disagreement with the supervisory authority of the host Member State, the Autorité de contrôle prudentiel et de résolution may refer the matter to the European Insurance and Occupational Pensions Authority in accordance with Article 19 of Regulation (EU) No 1094/2010 of 24 November 2010.
