In the situations provided for in the last two paragraphs of Article L. 321-1, in Article L. 321-1-1 or in Article L. 321-11-2, the Autorité de contrôle prudentiel et de résolution may set up a collaboration platform with the supervisory authorities concerned to strengthen the exchange of information and improve collaboration between these supervisory authorities.
In the same situations, the Autorité de contrôle prudentiel et de résolution may ask the European Insurance and Occupational Pensions Authority to set up a collaboration platform when an insurance or reinsurance undertaking conducts or intends to conduct activities in France that are based on the freedom to provide services or the freedom of establishment.
The establishment of a collaboration platform referred to in the first two paragraphs of this article takes into account the supervision exercised by the competent authorities of the Member State of the European Union where the insurance or reinsurance undertakings have their registered office, which are solely responsible for examining their financial situation, operating conditions, solvency, liquidity and ability to meet their commitments at all times with regard to their policyholders, members, beneficiaries and reinsured undertakings.
The Autorité de contrôle prudentiel et de résolution shall provide the information necessary for the proper functioning of a collaboration platform when the European Insurance and Occupational Pensions Authority so requests, without prejudice to Article 35 of Regulation (EU) No 1094/2010 of the European Parliament and of the Council of 24 November 2010 establishing a European Supervisory Authority (European Insurance and Occupational Pensions Authority), amending Decision No 716/2009/EC and repealing Commission Decision 2009/79/EC.
