Article L631-3 of the French Code governing the entry and residence of foreign nationals and the right of asylum

Only in the case of behaviour likely to harm the fundamental interests of the State, or linked to activities of a terrorist nature, or constituting acts of explicit and deliberate incitement to discrimination, hatred or violence against a specific person or group of persons, may an expulsion decision be issued:

1° Foreign nationals who can prove by any means whatsoever that they have been habitually resident in France since reaching the age of thirteen at the most;

2° A foreign national who has been legally resident in France for more than twenty years;

> A foreign national who has been legally resident in France for more than twenty years
3° A foreign national who has been legally resident in France for more than ten years and who has been married for at least four years either to a French national who has retained French nationality, or to a foreign national covered by 1°, provided that community of life has not ceased since the marriage;

4° A foreign national who has been legally resident in France for more than ten years and who is the father or mother of a French minor child residing in France, provided that they can prove that they have effectively contributed to the upkeep and education of the child in accordance with the conditions laid down in article 371-2 of the Civil Code since the child’s birth or for at least one year;

5° Foreign nationals habitually resident in France if their state of health requires medical care, the lack of which could have exceptionally serious consequences for them and if, given the availability of healthcare and the characteristics of the healthcare system in the country of return, they could not effectively receive appropriate treatment there.

By way of derogation from this article, the foreign nationals mentioned in 1° to 5° may be the subject of an expulsion decision if they live in France in a state of polygamy.

By way of derogation from this article, a foreign national mentioned in 3° and 4° may be the subject of an expulsion decision pursuant to articles L. 631-1 or L. 631-2 if the acts on which the expulsion decision is based were committed against his or her spouse or children or any children over whom he or she exercises parental authority.

The fact that a foreign national mentioned in 1° to 5° has been definitively sentenced to a fixed term of imprisonment of at least five years does not prevent him/her from benefiting from the provisions of this article.

Article L631-3

Ne peut faire l’objet d’une décision d’expulsion qu’en cas de comportements de nature à porter atteinte aux intérêts fondamentaux de l’Etat, ou liés à des activités à caractère terroriste, ou constituant des actes de provocation explicite et délibérée à la discrimination, à la haine ou à la violence contre une personne déterminée ou un groupe de personnes :

1° L’étranger qui justifie par tous moyens résider habituellement en France depuis qu’il a atteint au plus l’âge de treize ans ;

2° L’étranger qui réside régulièrement en France depuis plus de vingt ans ;

3° L’étranger qui réside régulièrement en France depuis plus de dix ans et qui est marié depuis au moins quatre ans soit avec un ressortissant français ayant conservé la nationalité française, soit avec un ressortissant étranger relevant du 1°, à condition que la communauté de vie n’ait pas cessée depuis le mariage ;

4° L’étranger qui réside régulièrement en France depuis plus de dix ans et qui est père ou mère d’un enfant français mineur résidant en France, à condition qu’il établisse contribuer effectivement à l’entretien et à l’éducation de l’enfant dans les conditions prévues par l’article 371-2 du code civil depuis la naissance de celui-ci ou depuis au moins un an ;

5° L’étranger résidant habituellement en France si son état de santé nécessite une prise en charge médicale dont le défaut pourrait avoir pour lui des conséquences d’une exceptionnelle gravité et si, eu égard à l’offre de soins et aux caractéristiques du système de santé du pays de renvoi, il ne pourrait pas y bénéficier effectivement d’un traitement approprié.

Par dérogation au présent article, l’étranger mentionné aux 1° à 5° peut faire l’objet d’une décision d’expulsion s’il vit en France en état de polygamie.

Par dérogation au présent article, l’étranger mentionné aux 3° et 4° peut faire l’objet d’une décision d’expulsion en application des articles L. 631-1 ou L. 631-2 lorsque les faits à l’origine de la décision d’expulsion ont été commis à l’encontre de son conjoint ou de ses enfants ou de tout enfant sur lequel il exerce l’autorité parentale.

La circonstance qu’un étranger mentionné aux 1° à 5° a été condamné définitivement à une peine d’emprisonnement ferme au moins égale à cinq ans ne fait pas obstacle à ce qu’il bénéficie des dispositions du présent article.
