Article R2332-8 of the French Public procurement code

When the consultation involves the communication of information or media that are classified or protected in the interests of national security, the invitation to tender shall specify the requirements ensuring the protection of such information or media and the obligation for candidates and tenderers to ensure that sub-contractors comply with these requirements.
The Prime Minister’s order mentioned in article R. 2300-1 determines the nature of these requirements.

Lorsque la consultation implique la communication d’informations ou de supports classifiés ou protégés dans l’intérêt de la sécurité nationale, l’avis d’appel à la concurrence précise les exigences assurant la protection de ces informations ou supports et l’obligation pour les candidats et soumissionnaires de veiller à ce que les sous-contractants respectent ces exigences.
L’arrêté du Premier ministre mentionné à l’article R. 2300-1 détermine la nature de ces exigences.
