Article R41-10 of the French Code of Criminal Procedure

The accounting officer of the Directorate General of Public Finance shall proceed with the recovery of the criminal order on expiry of the period of forty-five days from the date of dispatch of the registered letter provided for in Articles 495-3 and R. 41-3 or notification by the public prosecutor or his delegate as provided for in these same articles, unless an objection is lodged.

Le comptable de la direction générale des finances publiques procède au recouvrement de l’ordonnance pénale à l’expiration du délai de quarante-cinq jours à compter de la date d’envoi de la lettre recommandée prévue aux articles 495-3 et R. 41-3 ou de la notification par le procureur de la République ou son délégué prévue par ces mêmes articles, à moins qu’il ne soit fait opposition.
