Following accidents, disasters, catastrophes or offences likely to cause numerous victims, administrations, within the meaning of article L. 100-3 du code des relations entre le public et l’administration, involved in crisis management, caring for the victims of these events, supporting them or enforcing their rights, the public prosecutors’ offices and courts in charge of the proceedings as well as approved victim support associations within the meaning of the last paragraph of article 41 of this code may exchange with each other the data, information or documents strictly necessary to carry out these missions as well as to inform persons present at the scene of events and their relatives.
Any person receiving data, information or documents pursuant to the first paragraph of this article is bound by professional secrecy under the conditions and subject to the penalties laid down in articles 226-13 and 226-14 of the Penal Code.
A decree in the Council of State, issued after consultation with the Commission nationale de l’informatique et des libertés, sets out the terms and conditions for the application of this article.
