Article 1008 of the French Code of civil procedure

If the statement of appeal has been made in the form of the procedure with compulsory representation, the appeal is nonetheless admissible regardless of the procedure subsequently followed, paragraph 1 of article 1004 nevertheless remains applicable.

The defendant is not required to be represented by a lawyer at the Conseil d’Etat and the Cour de cassation.

Si la déclaration de pourvoi a été faite dans les formes de la procédure avec représentation obligatoire, le pourvoi n’en est pas moins recevable quelle que soit la procédure ultérieurement suivie, l’alinéa 1er de l’article 1004 demeurant néanmoins applicable.

Le défendeur n’est pas tenu de se faire représenter par un avocat au Conseil d’Etat et à la Cour de cassation.
