Article 1010 of the French Code of civil procedure

The cross-appeal, even if provoked, must, on pain of inadmissibility pronounced ex officio, be made in the form of a factum and contain the same particulars as the plaintiff’s factum.

The factum must, under the same penalty:

– be delivered to the registry of the Cour de cassation before the expiry of the time-limit laid down for the delivery of the factum in reply;

– be served within the same time-limit on the lawyers of the other parties to the cross-appeal. If, in matters where representation is compulsory, the defendant has not constituted a lawyer, the statement of case must be served on him at the latest within one month of the expiry of that period; however, if, in the meantime, the defendant constitutes a lawyer before service of the statement of case, his lawyer shall be served.

The defendant to such an appeal shall have a period of one month from the date of service to submit, and if appropriate serve, his statement of case in response.

Article 1010

Le pourvoi incident, même provoqué, doit, à peine d’irrecevabilité prononcée d’office, être fait sous forme de mémoire et contenir les mêmes indications que le mémoire du demandeur.

Le mémoire doit, sous la même sanction :

– être remis au greffe de la Cour de cassation avant l’expiration du délai prévu pour la remise du mémoire en réponse ;

– être notifié dans le même délai aux avocats des autres parties au pourvoi incident. Si, dans les matières où la représentation est obligatoire, le défendeur n’a pas constitué avocat, le mémoire doit lui être signifié au plus tard dans le mois suivant l’expiration de ce délai ; cependant, si, entre-temps, le défendeur constitue avocat avant la signification du mémoire, il est procédé par voie de notification à son avocat.

Le défendeur à un tel pourvoi dispose d’un délai d’un mois à compter de la notification pour remettre, et s’il y a lieu notifier, son mémoire en réponse.
