Article 1012 of the French Code of civil procedure

The chairman of the panel to which the case is distributed shall appoint a councillor or a referendary councillor of that panel as rapporteur.

He may immediately fix the date of the hearing.

He may, after obtaining the agreement of the parties, appoint a mediator to hear the parties and compare their points of view to enable them to find a solution to the dispute between them, in accordance with Article 131-1. The decision ordering mediation is taken after the pleadings have been lodged and, if necessary, after the Attorney General has given his opinion. The president of the panel to which the case has been assigned sets the duration of the mediation in accordance with article 131-3, in consideration of the date of the hearing he has set.

Le président de la formation à laquelle l’affaire est distribuée désigne un conseiller ou un conseiller référendaire de cette formation en qualité de rapporteur.

Il peut fixer aussitôt la date de l’audience.

Il peut, après avoir recueilli l’accord des parties, désigner un médiateur afin d’entendre les parties et de confronter leurs points de vue pour leur permettre de trouver une solution au conflit qui les oppose, conformément à l’article 131-1. La décision ordonnant la médiation est prise après le dépôt des mémoires et, s’il y a lieu, après avis du procureur général. Le président de la formation à laquelle l’affaire a été distribuée fixe la durée de la médiation conformément à l’article 131-3, en considération de la date de l’audience qu’il a fixée.
