Article 1031-2 of the French Code of civil procedure

The decision requesting the opinion is sent, together with the submissions and any written observations, by the court registry to the registry of the Cour de cassation. It is notified, as well as the date of transmission of the file, to the parties by registered letter with acknowledgement of receipt. The public prosecutor at the court is notified as well as the first president of the court of appeal and the public prosecutor when the request for an opinion does not emanate from the court.

La décision sollicitant l’avis est adressée, avec les conclusions et les observations écrites éventuelles, par le greffe de la juridiction au greffe de la Cour de cassation. Elle est notifiée, ainsi que la date de transmission du dossier, aux parties par lettre recommandée avec demande d’avis de réception. Le ministère public auprès de la juridiction est avisé ainsi que le premier président de la cour d’appel et le procureur général lorsque la demande d’avis n’émane pas de la cour.
