Article 1032 of the French Code of civil procedure

The referring court shall be seised by a declaration made at the registry of that court.

Where the referring court is seised by the Public Prosecutor, the declaration shall be made by the person exercising that function before the said court, where appropriate at the request of the person exercising that function before the court whose decision has been quashed.

La juridiction de renvoi est saisie par déclaration au greffe de cette juridiction.

Lorsque la juridiction de renvoi est saisie par le ministère public, la déclaration est faite par celui qui l’exerce près ladite juridiction, le cas échéant sur demande de celui qui l’exerce près la juridiction dont la décision a été cassée.
