Article 1044 of the French Code of civil procedure

If a question of nationality is raised by a party before a court that considers that there is a preliminary question, the court shall refer that party to appeal to the competent judicial court within a period of one month or, within the same period, to submit a request to the public prosecutor. Where the person whose nationality is in dispute relies on a certificate of French nationality, or where the question of nationality has been raised ex officio, the court hearing the case on the merits shall set the Public Prosecutor the same one-month time limit to refer the matter to the competent judicial court.

If the one-month time limit is not observed, the proceedings shall continue. Otherwise, the court hearing the case on the merits shall stay the proceedings until the nationality issue has been decided.

Si une question de nationalité est soulevée par une partie devant une juridiction qui estime qu’il y a question préjudicielle, la juridiction renvoie cette partie à se pourvoir devant le tribunal judiciaire compétent dans le délai d’un mois ou, dans le même délai, à présenter requête au procureur de la République. Lorsque la personne dont la nationalité est contestée se prévaut d’un certificat de nationalité française, ou lorsque la question de nationalité a été relevée d’office, la juridiction saisie au fond impartit le même délai d’un mois au procureur de la République pour saisir le tribunal judiciaire compétent.

Si le délai d’un mois n’est pas respecté, l’instance poursuit son cours. Dans le cas contraire, la juridiction saisie au fond surseoit à statuer jusqu’à ce que la question de nationalité ait été jugée.
