Article 1046 of the French Code of civil procedure

The public prosecutor with territorial jurisdiction to carry out the administrative rectification of purely material errors and omissions in civil status records and the annulment of irregularly drawn up records is the public prosecutor for the place where the record containing the initial error or omission or the irregularly drawn up record was drawn up.

The public prosecutor for the place where the record containing the initial error or omission or the irregularly drawn up record was drawn up is the public prosecutor for the place where the record containing the initial error or omission or the irregularly drawn up record was drawn up.
However, the following shall have jurisdiction:

>
1° The public prosecutor for the place where the central civil status department of the Ministry of Foreign Affairs is based, for records held by this department;

>
2° The public prosecutor at the Paris judicial court for certificates in lieu of civil status records to a refugee, stateless person or beneficiary of subsidiary protection.

Article 1046

Le procureur de la République territorialement compétent pour procéder à la rectification administrative des erreurs et omissions purement matérielles des actes de l’état civil et à l’annulation des actes irrégulièrement établis est le procureur de la République du lieu où a été établi l’acte comportant l’erreur ou l’omission initiale ou l’acte irrégulièrement dressé.

Toutefois, sont compétents :

1° Le procureur de la République du lieu où est établi le service central d’état civil du ministère des affaires étrangères, pour les actes détenus par ce service ;

2° Le procureur de la République près le tribunal judiciaire de Paris pour les certificats tenant lieu d’actes de l’état civil à un réfugié, un apatride ou un bénéficiaire de la protection subsidiaire.
