Article 1055-3 of the French Code of civil procedure

Claims made pursuant to the provisions of the third paragraph of article 57 and the last paragraph of article 60 of the Civil Code obey the rules of ordinary written procedure applicable before the judicial court.

However, the decision is enforceable on a provisional basis only if it so orders.

Les demandes formées en application des dispositions du troisième alinéa de l’article 57 et du dernier alinéa de l’article 60 du code civil obéissent aux règles de la procédure écrite ordinaire applicable devant le tribunal judiciaire.

Toutefois, la décision n’est exécutoire à titre provisoire que si elle l’ordonne.
