Article 1056-2 of the French Code of civil procedure

The public prosecutor with territorial jurisdiction to oppose the celebration of a marriage of a French national abroad is that of the place where the central civil status department of the Ministry of Foreign Affairs is established.

He alone is also competent to rule on the transcription of the foreign marriage record in French civil status registers and to pursue the annulment of this marriage.

It also has sole jurisdiction, where the foreign marriage record has been transcribed onto the French consular registers, to pursue the annulment of the marriage, even if the matter was not referred to it prior to the transcription.

Il est également seul compétent, lorsque l’acte de mariage étranger a été transcrit sur les registres consulaires français, pour poursuivre l’annulation du mariage, même s’il n’a pas été saisi préalablement à la transcription.
