Article 1069 of the French Code of civil procedure

The appeal is lodged, investigated and judged as in non-contentious matters.

The time limit for appeal shall run, with regard to the parties and third parties to whom the judgment has been notified, one month after the expiry of the time limit set by the court for the completion of the publicity measures of article 127 of the Civil Code.

The time limit for lodging an appeal in cassation suspends the enforcement of the decision declaring absence. An appeal in cassation lodged within this time limit also suspends enforcement.

L’appel est formé, instruit et jugé comme en matière gracieuse.

Le délai d’appel court à l’égard des parties et des tiers auxquels le jugement a été notifié, un mois après l’expiration du délai fixé par le tribunal pour l’accomplissement des mesures de publicité de l’article 127 du code civil.

Le délai de pourvoi en cassation suspend l’exécution de la décision déclarative d’absence. Le pourvoi en cassation exercé dans ce délai est également suspensif.
