Article 1072 of the French Code of civil procedure

Without prejudice to any other investigative measure and subject to the provisions of the third paragraph of article 373-2-12 of the Civil Code, the judge may, even of his own motion, order a social enquiry if he considers that he is not sufficiently informed by the information available to him.

The social enquiry focuses on the family’s situation and, where applicable, on the possibilities of realising the plan of the parents or of one of them regarding the arrangements for exercising parental authority.

It gives rise to a report in which the investigator’s findings and proposed solutions are recorded.

The judge communicates the report to the parties, setting a time limit within which they will have the option of requesting a further investigation or a new investigation.

Article 1072

Sans préjudice de toute autre mesure d’instruction et sous réserve des dispositions prévues au troisième alinéa de l’article 373-2-12 du code civil, le juge peut, même d’office, ordonner une enquête sociale s’il s’estime insuffisamment informé par les éléments dont il dispose.

L’enquête sociale porte sur la situation de la famille ainsi que, le cas échéant, sur les possibilités de réalisation du projet des parents ou de l’un d’eux quant aux modalités d’exercice de l’autorité parentale.

Elle donne lieu à un rapport où sont consignées les constatations faites par l’enquêteur et les solutions proposées par lui.

Le juge donne communication du rapport aux parties en leur fixant un délai dans lequel elles auront la faculté de demander un complément d’enquête ou une nouvelle enquête.
