Article 1076-1 of the French Code of civil procedure

Where one of the parties has only requested the payment of alimony or a contribution to the expenses of the marriage, the judge may not grant the divorce without inviting the parties to explain the payment of a compensatory allowance.

Lorsqu’une des parties n’a demandé que le versement d’une pension alimentaire ou d’une contribution aux charges du mariage, le juge ne peut prononcer le divorce sans avoir invité les parties à s’expliquer sur le versement d’une prestation compensatoire.
