Article 1099 of the French Code of civil procedure

On the appointed day, the judge proceeds in accordance with the procedures set out in articles 250 to 250-3 of the Civil Code; it verifies the admissibility of the application; it ensures that the spouses’ consent is free and informed and draws their attention to the importance of the commitments made by them, particularly with regard to the exercise of parental authority.

With the agreement of the parties, in the presence of the lawyer(s), the judge may have any clauses of the agreement deleted or amended that appear to him or her to be contrary to the interests of the children or of one of the spouses.

The judge will immediately hand down a judgment homologating the agreement and granting the divorce.

Au jour fixé, le juge procède selon les modalités prévues aux articles 250 à 250-3 du code civil ; il vérifie la recevabilité de la requête ; il s’assure que le consentement des époux est libre et éclairé et appelle leur attention sur l’importance des engagements pris par eux, notamment quant à l’exercice de l’autorité parentale.

Avec l’accord des parties, en présence du ou des avocats, le juge peut faire supprimer ou modifier les clauses de la convention qui lui paraîtraient contraires à l’intérêt des enfants ou de l’un des époux.

Il rend sur-le-champ un jugement par lequel il homologue la convention et prononce le divorce.
