Article 1101 of the French Code of civil procedure

The six-month time limit for submitting a new agreement is suspended in the event of an appeal.

Failing the submission of a new agreement within the time limit, the judge shall, by order, declare of his own motion that the application for divorce has lapsed.

When the spouses submit a new agreement, the parties are summoned according to the procedures set out in Article 1092. If he refuses to approve it, the judge issues an order declaring that the application for divorce has lapsed.

Article 1101

Le délai de six mois pour présenter une nouvelle convention est suspendu en cas d’appel.

A défaut de présentation d’une nouvelle convention dans le délai fixé, le juge constate d’office, par ordonnance, la caducité de la demande en divorce.

Lorsque les époux présentent une nouvelle convention, les parties sont convoquées selon les modalités prévues à l’article 1092. S’il refuse de l’homologuer, le juge rend une ordonnance par laquelle il constate la caducité de la demande en divorce.
