Article 1128 of the French Code of civil procedure

A request that the family court judge be dispensed from stating the wrongs and grievances of the spouses in the grounds of his or her decision must be expressly and concordantly formulated in the submissions of both spouses.

The family court judge confines himself or herself to finding that the facts constituting grounds for divorce exist in accordance with the Civil Code, Title “Of Divorce”, Section IV, Chapter I.

La demande tendant à dispenser le juge aux affaires familiales d’énoncer dans les motifs de sa décision les torts et griefs des époux doit être formulée de façon expresse et concordante dans les conclusions de l’un et l’autre époux.

Le juge aux affaires familiales se borne à constater qu’il existe les faits constitutifs d’une cause de divorce selon le code civil, titre “Du divorce”, section IV, du chapitre Ier.
