Article 113-2 of the French Code of Criminal Procedure

Any person named in a complaint or implicated by the victim may be heard as an assisted witness. When they appear before the examining magistrate, they must be heard in this capacity if they so request; if the person is named in a complaint with civil party status, they are notified of this right when they appear before the examining magistrate.

Any person implicated by a witness or against whom there is evidence making it likely that they may have participated, as perpetrator or accomplice, in the commission of the offences referred to the examining magistrate may be heard as an assisted witness.

Article 113-2

Toute personne nommément visée par une plainte ou mise en cause par la victime peut être entendue comme témoin assisté. Lorsqu’elle comparaît devant le juge d’instruction, elle est obligatoirement entendue en cette qualité si elle en fait la demande ; si la personne est nommément visée par une plainte avec constitution de partie civile, elle est avisée de ce droit lorsqu’elle comparaît devant le juge d’instruction.

Toute personne mise en cause par un témoin ou contre laquelle il existe des indices rendant vraisemblable qu’elle ait pu participer, comme auteur ou complice, à la commission des infractions dont le juge d’instruction est saisi peut être entendue comme témoin assisté.
