Article 113-4 of the French Code of Criminal Procedure

At the first hearing of the assisted witness, the investigating judge shall establish his or her identity, inform him or her of the initiating indictment, the complaint or the information, inform him or her of his or her right to make statements, to answer questions put to him or her or to remain silent, as well as the rights mentioned in Article 113-3, and proceed with the formalities provided for in the last two paragraphs of l’article 116. Mention of this information is made in the minutes.

The investigating judge may, by sending a registered letter, inform a person that he or she will be heard as an assisted witness. This letter includes the information provided for in the previous paragraph. It specifies that the name of the lawyer chosen or the request to appoint a court-appointed lawyer must be communicated to the investigating judge’s clerk.

Lors de la première audition du témoin assisté, le juge d’instruction constate son identité, lui donne connaissance du réquisitoire introductif, de la plainte ou de la dénonciation, l’informe de son droit de faire des déclarations, de répondre aux questions qui lui sont posées ou de se taire ainsi que des droits mentionnés à l’article 113-3 et procède aux formalités prévues aux deux derniers alinéas de l’article 116. Mention de cette information est faite au procès-verbal.

Le juge d’instruction peut, par l’envoi d’une lettre recommandée, faire connaître à une personne qu’elle sera entendue en qualité de témoin assisté. Cette lettre comporte les informations prévues à l’alinéa précédent. Elle précise que le nom de l’avocat choisi ou la demande de désignation d’un avocat commis d’office doit être communiqué au greffier du juge d’instruction.
