Article 1136-12 of the French Code of civil procedure

An application for the protection order to be lifted or modified or for temporary dispensation from certain of its obligations, as well as an application for the order to be revoked or for new measures to be ordered, shall be made, investigated and judged under the same conditions as the initial application.

However, where an appeal has been lodged, the application is made by petition delivered or addressed to the registry of the court of appeal. The application shall be decided by the first president of the court of appeal, the Conseiller de la Mise en Condition or the bench, as the case may be.

La demande aux fins de mainlevée ou de modification de l’ordonnance de protection ou de dispense temporaire de certaines de ses obligations ainsi que celle tendant à voir rapporter l’ordonnance ou prononcer de nouvelles mesures sont formées, instruites et jugées dans les mêmes conditions que la requête initiale.


Toutefois, lorsqu’un appel a été interjeté, la demande est formée par requête remise ou adressée au greffe de la cour d’appel. Il est statué sur celle-ci, selon le cas, par le premier président de la cour d’appel, le conseiller de la mise en état ou la formation de jugement.
