Where an application for divorce or legal separation is lodged before the expiry of the term of the protection measures or where the protection order is issued while divorce or legal separation proceedings are in progress, the measures of the protection order continue to have effect until a decision on the application for divorce or legal separation has become res judicata, unless otherwise decided by the judge hearing the application or by the pre-trial judge. In the latter case, as from the notification of the order of the status judge, the provisional measures of the divorce proceedings replace the measures of the protection order taken under 3° and 5° of the article 515-11 of the Civil Code which cease to have effect.
As from the commencement of proceedings for divorce or legal separation, the application for protective measures and the applications referred to in the first paragraph of Article 1136-12 shall be made before the judge hearing those proceedings. The claim shall be lodged, investigated and judged in accordance with the rules of this section and the court shall rule by separate decision.
