Article 1136-16 of the French Code of civil procedure

Where the wearing of a mobile anti-collision device provided for in article 515-11-1 of the Civil Code is requested by either of the parties, any information relating to the family situation shall be attached in support of the request, material and social situation of the two parties, to enable the judge to determine the warning and pre-alert distances defined in article 1136-17 of this Code.

When the judge orders the wearing of a mobile anti-seizure device, he shall ensure that the parties, and in particular the defendant, have had sufficient time to reflect to be able to give free and informed consent.

Lorsque le port d’un dispositif mobile anti-rapprochement prévu à l’article 515-11-1 du code civil est demandé par l’une ou l’autre des parties, il est joint au soutien de la demande tout élément relatif à la situation familiale, matérielle et sociale des deux parties, afin de permettre au juge de déterminer les distances d’alerte et de pré-alerte, définies à l’article 1136-17 du présent code.


Lorsque le juge ordonne le port d’un dispositif mobile anti-rapprochement, il s’assure que les parties, et en particulier la partie défenderesse, ont disposé d’un délai de réflexion suffisant pour pouvoir donner un consentement libre et éclairé.
