A mention of the divorce is made in the margin of the marriage certificate and the birth certificate of each of the spouses, at the request of the interested party or his or her lawyer, on the basis of a certificate of filing issued by the notary. The certificate states the identity of the spouses and the date of filing.
If the marriage was celebrated abroad and there is no marriage record kept by a French civil registrar, mention of the divorce is made in the margin of the birth record of each of the spouses, if this record is kept in a French civil register. Failing this, the certificate of filing is kept in the register mentioned in Article 4-1 of the decree of 1 June 1965 creating a central civil status department at the Ministry of Foreign Affairs.
However, this entry may only be made in the margin of the birth certificate of a French national after transcription into the civil status registers of the marriage certificate celebrated by the foreign authority as of 1st March 2007.
