Article 1148-2 of the French Code of civil procedure

As soon as a minor child expresses his or her wish to be heard by the judge under the conditions provided for in article 388-1 of the Civil Code, the court may be seised in accordance with the procedures set out in articles 1088 to 1092.

The spouses may also, until the divorce agreement is filed with a notary, apply to the court for legal separation or divorce under the conditions provided for in articles 1106 and 1107.

Dès qu’un enfant mineur manifeste son souhait d’être entendu par le juge dans les conditions prévues à l’article 388-1 du code civil, la juridiction peut être saisie selon les modalités prévues aux articles 1088 à 1092.


Les époux peuvent également, jusqu’au dépôt de la convention de divorce au rang des minutes d’un notaire, saisir la juridiction d’une demande de séparation de corps ou de divorce judiciaire dans les conditions prévues aux articles 1106 et 1107.
