Article 117 of the French Civil Code

The Public Prosecutor’s Office is specially responsible for looking after the interests of presumed absentees; it is heard on all applications concerning them; it may ex officio request the application or modification of the measures provided for in this title.

Le ministère public est spécialement chargé de veiller aux intérêts des présumés absents ; il est entendu sur toutes les demandes les concernant ; il peut requérir d’office l’application ou la modification des mesures prévues au présent titre.
