Article 1180-5-1 of the French Code of civil procedure

Where the judge decides that the child will be handed over with the assistance of a trusted third party pursuant to articles 373-2-1 or 373-2-9 of the Civil Code, it appoints the person responsible for this task, on the joint proposal of the parents or one of them, and subject to the written agreement of this person. The judge shall also designate, as a subsidiary measure, a meeting place where the child will be handed over, with the parents or one of them being responsible for referring the matter to the person in charge of this meeting place if the trusted third party fails to act.

The judge may at any time modify or revoke his decision ex officio, at the joint request of the parties or one of them, or at the request of the public prosecutor.

Lorsque le juge décide que la remise de l’enfant s’exercera avec l’assistance d’un tiers de confiance en application des articles 373-2-1 ou 373-2-9 du code civil, il désigne la personne chargée de cette mission, sur proposition commune des parents ou de l’un d’eux, et sous condition de l’accord écrit de cette personne. Il fixe les modalités de la mesure et sa durée.

Le juge désigne également, à titre subsidiaire, un espace de rencontres dans lequel est assurée la remise de l’enfant, à charge pour les parents ou l’un d’eux de saisir le responsable de cet espace en cas de carence du tiers de confiance.

Le juge peut à tout moment modifier ou rapporter sa décision d’office, à la demande conjointe des parties ou de l’une d’entre elles, ou à la demande du ministère public.
