In contracts the object of which is the alienation of ownership or the assignment of another right, the transfer takes place when the contract is concluded.
This transfer may be deferred by the will of the parties, the nature of the things or by the effect of the law.
The transfer of ownership entails the transfer of the risks of the thing. However, the debtor of the obligation to deliver regains responsibility for it from the time of his formal notice, in accordance with Article 1344-2and subject to the rules set out in article 1351-1.
