Article 1228 of the French Code of civil procedure

When applying article 442 or paragraph 5 of article 494-6 of the Civil Code, the judge shall rule after hearing or calling the protected person under the conditions provided for in articles 1220 to 1220-2 of the present code and obtained the opinion of the person responsible for protection. Its decision is notified under the conditions provided for in articles 1230 to 1231 of the same code.

However, where it is necessary to strengthen the protection regime pursuant to the fourth paragraph of Article 442 of the Civil Code, it is also carried out in accordance with the provisions of Articles 1218,1220-3 to 1221,1225 and 1226 of this code.

Article 1228

Lorsqu’il fait application de l’article 442 ou de l’alinéa 5 de l’article 494-6 du code civil, le juge statue après avoir entendu ou appelé la personne protégée dans les conditions prévues aux articles 1220 à 1220-2 du présent code et recueilli l’avis de la personne chargée de la protection. Sa décision est notifiée dans les conditions prévues aux articles 1230 à 1231 du même code.

Toutefois, lorsqu’il y a lieu de renforcer le régime de protection en application du quatrième alinéa de l’article 442 du code civil, il est en outre procédé conformément aux dispositions des articles 1218,1220-3 à 1221,1225 et 1226 du présent code.
