Article 1245-5 of the French Civil Code

A producer, when acting in a professional capacity, is the manufacturer of a finished product, the producer of a raw material, the manufacturer of a component part.

Any person acting in a professional capacity is treated in the same way as a producer for the purposes of this chapter:

1° Who presents himself as a producer by affixing his name, trade mark or other distinctive sign to the product;

2° Who imports a product into the European Community with a view to sale, hire, with or without a promise to sell, or any other form of distribution.

Persons whose liability may be sought on the basis of articles 1792 à 1792-6 and 1646-1.

Article 1245-5

Est producteur, lorsqu’il agit à titre professionnel, le fabricant d’un produit fini, le producteur d’une matière première, le fabricant d’une partie composante.

Est assimilée à un producteur pour l’application du présent chapitre toute personne agissant à titre professionnel :

1° Qui se présente comme producteur en apposant sur le produit son nom, sa marque ou un autre signe distinctif ;

2° Qui importe un produit dans la Communauté européenne en vue d’une vente, d’une location, avec ou sans promesse de vente, ou de toute autre forme de distribution.

Ne sont pas considérées comme producteurs, au sens du présent chapitre, les personnes dont la responsabilité peut être recherchée sur le fondement des articles 1792 à 1792-6 et 1646-1.
