Article 1245 of the French Code of civil procedure

The appeal is heard and decided in chambers.

The procedure is oral.

The parties’ submissions or the reference they make to submissions they would have made in writing are noted on the file or recorded in minutes.

At the hearing, the court shall hear the appellant, the adult to be protected or protected, unless the court applies the provisions of the second paragraph of article 432 or article 494-4 of the Civil Code and, where appropriate, the public prosecutor.

The parties’ lawyers, where they have constituted one, are heard in their observations.

L’appel est instruit et jugé en chambre du conseil.

La procédure est orale.

Les prétentions des parties ou la référence qu’elles font aux prétentions qu’elles auraient formulées par écrit sont notées au dossier ou consignées dans un procès-verbal.

A l’audience, la cour entend l’appelant, le majeur à protéger ou protégé, sauf application par la cour des dispositions du second alinéa de l’article 432 ou de l’article 494-4 du code civil et, le cas échéant, le ministère public.

Les avocats des parties, lorsqu’elles en ont constitué un, sont entendus en leurs observations.
