Article 1258-3 of the French Code of civil procedure

If all the required conditions are met, the court clerk, after initialling each page of the mandate, mentions at the end of the deed that it takes effect from the date of its presentation to the court clerk’s office, endorses it and returns it to the agent, together with the documents produced.

If the court clerk considers that the conditions have not been met, he returns the mandate to the agent, together with the accompanying documents, without endorsing it.

In this case, the attorney may apply to the judge. The judge may rule without debate and his decision is not subject to appeal. If the judge considers that the requisite conditions have been met, the Registrar shall proceed, at the request of the mandatary, in accordance with the first paragraph.

Si l’ensemble des conditions requises est rempli, le greffier, après avoir paraphé chaque page du mandat, mentionne, en fin d’acte, que celui-ci prend effet à compter de la date de sa présentation au greffe, y appose son visa et le restitue au mandataire, accompagné des pièces produites.

Si le greffier estime les conditions non remplies, il restitue, sans le viser, le mandat au mandataire ainsi que les pièces qui l’accompagnent.

Dans ce cas, le mandataire peut saisir le juge par requête. Celui-ci peut se prononcer sans débat et sa décision n’est pas susceptible d’appel. Si le juge estime les conditions requises remplies, le greffier procède, à la demande du mandataire, conformément au premier alinéa.
